1. Introduction

These Terms of Service ("Terms") govern your access to and use of the PackPace mobile application, website, and related services (collectively, the "Service").

By accessing or using PackPace, you agree to be bound by these Terms. If you do not agree, do not use the Service.

If PackPace is accessed through the Apple App Store or Google Play, you acknowledge that the applicable app store may enforce these Terms as a third-party beneficiary.

Nothing in these Terms creates an employment, partnership, agency, or joint venture relationship.

2. Eligibility

You must be at least 13 years old (or the minimum legal age in your jurisdiction) to use PackPace. By using the Service, you represent that you meet these requirements.

You may not use PackPace if you are prohibited by applicable laws or located in a jurisdiction subject to U.S. trade restrictions.

3. Description of the Service

PackPace is a digital fitness, activity tracking, and social platform designed to help dog owners engage in running, play, and exercise activities with their dogs.

PackPace:

• Tracks user-initiated activities such as running, walking, and play
• Provides educational and data-informed recommendations
• Enables social interaction, packs, challenges, and heatmaps
• Does not rely on dog-worn hardware devices

PackPace does not provide veterinary, medical, or professional health advice.

4. Health & Safety Disclaimer

PackPace provides general wellness and activity guidance only.

• Recommendations are informational and educational
• PackPace does not diagnose, treat, or prevent disease
• You are solely responsible for assessing your dog's fitness and safety
• Always consult a licensed veterinarian before beginning new exercise routines

Use of the Service is at your own risk.

5. User Accounts

To access certain features, you may be required to create an account.

You agree to:

• Provide accurate and current information
• Maintain the security of your account credentials
• Accept responsibility for all activity under your account

PackPace may suspend or terminate accounts for violations of these Terms.

6. Acceptable Use

You agree not to:

• Violate any laws or third-party rights
• Upload unlawful, harmful, abusive, or misleading content
• Scrape, harvest, or reverse engineer the Service
• Use the Service for commercial promotion without permission
• Misrepresent affiliations or endorsements

PackPace reserves the right to remove content or restrict access for violations.

7. User Content

You retain ownership of content you upload (photos, activity notes, comments).

By submitting content, you grant PackPace a non-exclusive, worldwide, royalty-free license to use, display, and distribute such content solely to operate and promote the Service.

You are responsible for ensuring you have rights to all content you submit.

8. Intellectual Property

All PackPace software, branding, trademarks, designs, and content (excluding user content) are owned by PackPace, LLC or its licensors.

You may not copy, modify, distribute, or exploit PackPace intellectual property without written permission.

9. Subscriptions & Paid Features

PackPace offers optional paid subscriptions ("Premium").

Premium features may include:

• Creating additional packs
• Hosting or creating challenges
• Access to advanced heatmaps and insights

Billing & Renewal:

• Payments are processed through app stores or third-party processors
• Subscriptions automatically renew unless canceled
• You manage subscriptions through your app store account

No refunds are provided except where required by law.

10. Third-Party Services

PackPace may integrate with third-party platforms (e.g., Health Connect).

PackPace is not responsible for third-party services, content, availability, or data accuracy. Use of third-party services is governed by their respective terms.

11. Service Availability

PackPace may modify, suspend, or discontinue any part of the Service at any time.

We do not guarantee uninterrupted or error-free operation.

12. Disclaimer of Warranties (U.S.)

The Service is provided "AS IS" and "AS AVAILABLE."

PackPace disclaims all warranties, express or implied, including fitness for a particular purpose, accuracy, and reliability.

We do not guarantee that:

• Activities will be accurate
• Recommendations will meet your expectations
• The Service will be error-free or secure

13. Limitation of Liability

To the maximum extent permitted by law, PackPace and Local Martians shall not be liable for:

• Indirect, incidental, or consequential damages
• Loss of data, profits, or goodwill
• Injury to you or your dog resulting from use of the Service

Total liability shall not exceed the amount paid by you to PackPace in the prior 12 months.

14. Indemnification

You agree to indemnify and hold harmless PackPace, Local Martians, and their affiliates from any claims arising from:

• Your use of the Service
• Your content
• Your violation of these Terms or applicable laws

15. Privacy

Your use of PackPace is governed by our Privacy Policy, which explains how we collect, use, and protect your data.

16. Termination

You may stop using PackPace at any time.

PackPace may suspend or terminate access for violations of these Terms or legal requirements.

17. Governing Law

These Terms are governed by the laws of the United States and the State in which Local Martians is registered, without regard to conflict-of-law principles.

18. Changes to These Terms

We may update these Terms from time to time. Continued use of PackPace after updates constitutes acceptance.
